The president of the district council of Brasov, Aristotel Cancescu, has lost an important part of a legal procedure. On May 15, the president of the foundation Casa Don Bosco complained at Cancescu being the president of the controlling authority about the conditions in the direction of child proctection in Brasov. The main point of the complaint was the president and secretary of the district Mariana Tiharau and her management of the office. Already in 1993 she meant to close the children’s home Casa Don Bosco for street children, because the priest Don Demidoff – contrary to the still in that times prevailing communist ideology – admitted both boys and girls to his home. She therefore called the Father perverted. Don Demidoff has described the practices of this ”lady” already in his book ”Priest of Thorns”, as in court she indicated other fictional reasons for the claimed closure. Without any success, as she has remained to be a communist until today. She has been in office for 17 years, does not have any educational experience and changes her party according to the color of the government, she has now changed it for the forth time. M. Tiharau verifiably is member of the SRI, the former Securitate (state security). The media have suspected her among others to have sold children of her protection field to Italy, in other words to have illegally given them up for adoption. Already at that times Father Don Demidoff fought against this “lady” by legal measures. Already at that times the court in Brasov was recused due to conflict of interest and the process was relocated to Buzau. The defendant got around it, did not keep the date of the court hearing and lost the suit filed by herself. But, as said before, she still is in office until today. Only simple minds do not believe in bribe and in the power of her knowledge about the district councillors. Concerning the current matter the president of the district has remained silent for months and then finally left the answer to even this lady, as it was her responsibility. That is the way how it works in Romania. Imagine, you go to the police in order to report a thief, the police, however, refers the claimant back to the thief, because it was his responsibility. Even the judge in charge of the initially responsible court in Brasov reacted in an extraordinarily aggressive way to the claim of the lawyers of the foundation. Don Bosco had got an answer and that had to be sufficient. A clear case of an obvious conflict of interest. After all, as described in the comparative case: it is the responsibility of the thief. The administration of the legal department of the Supreme Court, the highest Romanian court for such proceedings, divested the court in Brasov of the process by judgment of December 4, Nr. 4697, and as well relocated the case to the court of Buzau.
